These Terms of Service, together with the Provider’s Privacy Policy, constitute a binding agreement between users of the Site (“you”, unless otherwise specified) and the Provider.

This Site is operated by HighGear Dispatch di Cristian Cosneanu doing business as (d/b/a) HighGear Dispatch (with principal offices at 225 Wilmington West Chester Pike, Chadds Ford, PA 19317, USA) and its affiliates (collectively the “Provider”, “we”, or “us”).

1.3. By accessing the Site, you represent and warrant that you are at least eighteen (18) years old and have the legal authority to agree to and accept this Agreement on your behalf.

2. Scope of this Agreement, Authority & Logistics Context

2.1. These Terms of Service only apply to your activities when using the Site or its contents.

2.2. These Terms of Service do not affect or amend the terms of any separate legal dispatcher-carrier agreements, power of attorney forms, or transport logistics contracts you have entered into or may enter into with HighGear Dispatch regarding active load booking (each referred to as “Provider Contract(s)”). Your structural relationship regarding active car hauling freight dispatching is governed by those specific agreements.

2.3. The Provider is based in the Commonwealth of Pennsylvania in the United States. The Provider provides services within the Site for use primarily by commercial motor carriers and owner-operators located and authorized to operate within the United States.

3. Changes to these Terms of Service

3.1. From time to time, the Provider may, in its sole discretion, for any reason and without any liability to you or any other person, change, supplement, or amend these Terms of Service by updating this posting.

3.2. You may not change, supplement, or amend these Terms of Service in any manner. Continued use of the Site constitutes your acceptance of any revisions.

4. Privacy Policy & Non-Disclosure

4.1. Please review our Privacy Policy, which explains our practices relating to the collection, secure handling, and non-disclosure of sensitive carrier paperwork (including MC/DOT authorities, W-9 forms, and Certificates of Insurance). By accessing and using our Site, you consent to our data protocols.

5. Intellectual Property Rights

5.1. The Provider retains all intellectual property rights in and to the Site, including all text, original graphics, specialized car hauler calculator interfaces, logo designs, and visual card layouts. No content may be reproduced without prior written permission.

6. Acceptable Use; Prohibited Use

6.1. You agree to use the Site in accordance with these Terms of Service and all federal motor carrier laws, rules, and regulations.

6.2. You agree not to provide to the Provider, or transmit through the Site, information and materials that are inaccurate, false, misleading, or fraudulent (including unauthorized or invalid MC/DOT numbers, fake certificates of insurance, or spoofed carrier data).

6.3. In addition, you agree not to use any robot, scraper, or other automated process to copy load results, lane data, or pricing grids from the Site without express permission.

7. Copyright Infringement

7.1. If you believe that your protected work has been copied or displayed on the Site in a way that constitutes copyright infringement, please notify our designated agent via email at with standard digital authentication parameters.

8. Disclaimer, Liability Exclusion, Liability Limitation, and Indemnity

8.1. Disclaimer: Your use of the site is at your own risk. The site and all contents are provided on an "as is" basis. The provider makes no warranties that route estimates, market freight data, or appraisals listed on the site will match constantly fluctuating spot market LTL/FTL auto freight values.

8.2. Liability Exclusion: To the fullest extent permitted by law, in no event will Cristian Cosneanu d/b/a HighGear Dispatch, or respective associates, be liable for any damages, consequential losses, lost trucking income, or revenue expenses arising out of the use or inability to use this site.

8.3. Indemnity: You agree to indemnify and hold harmless the provider from any claims, liabilities, losses, and expenses (including legal fees) arising out of your violation of these terms or misrepresentation of your carrier authority status.

9. Links to Third-Party Platforms

9.1. The Site may contain direct integrations or links to third-party portals, including digital factoring tools, loading platforms, or broker directories. We accept no responsibility or liability for data policies or terms enforced on third-party sites.

10. Termination of Site Access

10.1. The Provider reserves the right to suspend or restrict your access to contact forms, portal areas, or site usage at any time, without liability, if fraudulent credentials or bad faith usage is discovered.

11. Governing Law and Venue

11.1. These Terms of Service, your use of the Site, and all related matters shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, without application of its conflicts of laws principles. Any legal action or dispute arising out of or relating to this Site must be brought exclusively in a federal or state court of competent jurisdiction within the State of Pennsylvania.

12. Waiver; Severability

12.1. If any provision of these Terms of Service is deemed invalid, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

13. Limitation on Time to File Claims

13.1. Any cause of action or claim you may have arising out of or relating to these Terms of Service or the Site must be commenced within thirty (30) calendar days after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

16.1. Message frequency varies based on active dispatch status. You may receive up to 100 SMS notifications or direct messages weekly regarding active dispatch bookings, broker rate confirmations, and route updates.

17. Potential Fees for SMS Messaging

17.1. Standard message and data rates may apply depending on your mobile service carrier's pricing plan.

18. Opt-In, Opt-Out, and Help Methods

18.1. You may opt-in to receive operational transactional SMS messages from HighGear Dispatch verbally during phone onboarding, via online form submission, or via written email consent.

18.2. You can opt out of receiving SMS communications at any time. Simply reply “STOP” to any SMS text message you receive from us.

19. Types of Messages Users Can Expect to Receive

If you have provided consent to receive mobile notifications from HighGear Dispatch, you may expect messages regarding:

19.1. Conversational & Dispatch SMS: Details regarding freight pick-up/delivery locations, vehicle counts, target RPMs, carrier rate confirmations, and broker instructions.

19.2. Tracking & Updates: Status updates regarding operational setup packets, factoring approvals, and transit checks.
